DOJ asks SCOTUS to review “Remain in Mexico” ruling

The Department of Justice has asked the Supreme Court to review whether it has to continue implementing the “Remain in Mexico” policy.

The “Remain in Mexico” policy or Migrant Protection Protocols were established by the Trump Administration in January 2019. It had effectively eradicated the “Catch and Release” policy that has long been exploited by Cartels and gangs.

The policy deported illegal immigrants instead of releasing them on US soil for them to only abscond and never appear for their hearings. Critics of the policy, or the Left, has been vocal against it and deem it to be inhumane.

Repealing the “Remain in Mexico” policy was a key Biden promise during the campaign trail filled with such promises. He even managed to rescind the policy but had to reinstate it after Texas and Missouri sued, and a Federal Court blocked his decision.

In August, the Supreme Court had refused the Biden Administration’s request to suspend the Federal Judge’s order.

The DOJ then released a memo in October to end the program but it was struck down by the 5th Circuit Court of Appeals earlier in December. The appeals court said the Administration cannot just “write a word document” and make it online to strike down the policy.

The Biden Administration believes the policy has failed to address illegal immigration and has flaws.

Since the appeal has been denied, it is now hoping that the Supreme Court paves a way forward and clarifies whether the appeals court decision against the memo was a mistake.
