The case which has shocked America has taken a new turn. The Philadelphia train rape suspect was revealed to be a Congolese citizen who has a criminal record and overstayed his student visa since 2015.

Fiston Ngoy, 35, has been charged with rape and other counts after the October 13 incident that shocked the nation.

The incident took place on a SEPTA train in Upper Darby. The unidentified victim was riding the Market-Frankford Line.

She was sitting alone when Ngoy sat next to her and started the molestation, according to the police. Video surveillance cameras on the train show the woman continuously push Ngoy away after she entered the train at 9:20PM.

Just minutes later, the suspect began groping her left breast, the woman yet again tried to push him away. At 9:50PM, Ngoy removed the woman’s pants and lowered his pants too. He then began thrusting on top of her for over 5 minutes, according to the police.

Minutes before 10PM, a SEPTA police officer entered the train car and pulled Ngoy who was raping the victim, off of her.

The officer was responding to a call on a train coming to the 69th Street Terminal when he saw Ngoy on top of the woman with his pants undone.

The woman told the police at the hospital that she remembered leaving work, had a few beers and then remembered a SEPTA officer removing a man off of her.

The disturbing case has shocked the entire country. Not only did it put women’s safety under question but also highlighted the disturbing criminal negligence of the fellow passengers who just stood there and did nothing.

The police however, are encouraging witnesses to come forward with evidence. Earlier reports suggested that the witnesses could be charged, but the authorities have said Pennsylvania law does not allow the prosecution of idle bystanders not helping a victim.

Although, it isn’t a crime to stand and do nothing, it certainly raises questions on the moral obligation of the witnesses.

Ngoy who has been living illegally inside the US has a criminal record which includes two misdemeanor convictions. One for controlled substance use and one for sexual abuse.

He pled guilty in 2017 to the sexual abuse misdemeanor and faced a 120-day sentencing, with 9 months in probation.

Even with his criminal record and having been caught, Ngoy was not deported due to the red tape that mars the immigration system.
