Criminal complaint against Andrew Cuomo dismissed
A criminal complaint against estranged former New York Governor Andrew Cuomo has been dismissed by an Albany Judge on Friday.
The prosecution did not object against the dismissal as they did not have enough evidence that would lead to a conviction.
This was expected as Albany County District Attorney had already declined to prosecute Cuomo for allegedly groping Brittany Commisso in 2020.
The District Attorney found the “complainant” credible but said his office did not have enough evidence to lead to a conviction.
Cuomo’s lawyer Rita Glavin declared that “no Jury would have found Commisso credible.” Which is why “this case was dismissed,” according to her.
Commisso however, criticized the District Attorney’s decision to drop the case and become the Jury without a trial. She said this is why “victims are afraid to come forward, especially against people in power.”
She is now planning to file a civil suit against Cuomo. The Albany criminal case was the only criminal case against Cuomo for alleged groping in the area.
Two other District Attorneys had already announced not to prosecute the former Governor for alleged groping of women in those areas. This is the latest in a string of back-to-back decisions in favor of Cuomo.
Victims of sexual abuse and women’s rights activists are criticizing the District Attorneys for deciding whether the evidence is enough or not before the beginning of a trial. They believe the DAs to be paving a way out for Cuomo.
Andrew Cuomo resigned late in August as an impeachment loomed near after the New York Attorney General Letitia James released a report over his sexual misconduct.
